Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Inclusivity.org (the “Site”), operated by Inclusivity.org (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

What Inclusivity.org is

Inclusivity.org is an informational directory of inclusive and diverse-owned businesses and suppliers, together with an employer inclusion tracker. We help people discover and compare businesses and employers; we are neutral and do not endorse, guarantee, or recommend any particular business over another. Inclusion in the directory is not an endorsement, and the Site does not provide professional, legal, financial, or employment advice.

Eligibility

You must be at least 18 years old and able to form a binding contract to submit or claim a business, purchase a paid plan, or otherwise transact on the Site.

Listings, submissions, and claims

When you submit or claim a business, you represent that you are authorized to do so and that the information you provide is accurate and not misleading. You grant us a non-exclusive, worldwide, royalty-free license to host, display, adapt, and distribute the content you submit (including text, logos, and photos) for the purpose of operating and promoting the Site and its listings.

All submissions and claims are reviewed before publishing. We may accept, edit, decline, unpublish, or remove any listing or content at our discretion — for example, if we cannot verify a source, if content is inaccurate or violates these Terms, or upon a valid request.

Ownership and identity tags

Ownership and identity tags are self-identified by the business or sourced from public or certified records, and each carries a source and verification status. We never infer sensitive identity categories. By selecting tags, you confirm they are accurate. You may request a correction or removal at any time through our corrections and removals process.

Paid plans and billing

Some listing upgrades (such as Enhanced and Featured plans) are paid, billed monthly or annually. Prices, features, and limits are described on our pricing page and may change. Paid features, priority placement, and welcome kits are provided after review and payment. A paid plan does not guarantee any specific result, ranking, lead volume, or level of visibility. Fulfillment of physical welcome kits may take several weeks, and kit contents may vary.

Acceptable use

You agree not to:

  • Submit false, misleading, infringing, or unauthorized content.
  • Claim a business you are not authorized to represent.
  • Scrape, harvest, or copy the directory or its data except as permitted.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site.
  • Use the Site to harass, defame, or discriminate against any person or business.

Intellectual property

The Site, including its design, text, graphics, logos, and software, is owned by us or our licensors and protected by intellectual-property laws. Except for content you submit, you may not reproduce, distribute, or create derivative works from the Site without our permission.

Third-party content, scores, and certifications

Employer benchmark scores, certifications, recognitions, and similar data belong to their respective organizations. We report sourced, public, or company-submitted information and attribute it accordingly, and we do not claim affiliation with those organizations unless explicitly stated. The Site may also link to third-party websites we do not control and are not responsible for.

Advertising

The Site may display third-party advertising, including through Google AdSense. Ads and advertiser content are the responsibility of the advertisers, and their appearance does not imply our endorsement. See our Privacy Policy for how advertising cookies are used and how to opt out.

Disclaimers

The Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings, tags, scores, or other information are error-free or current, and you use the Site and rely on its information at your own risk.

Limitation of liability

To the fullest extent permitted by law, Inclusivity.org and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising from your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed the amount you paid us, if any, in the twelve months before the claim.

Indemnification

You agree to indemnify and hold harmless Inclusivity.org and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Site, or your violation of these Terms.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the United States and the state in which the operator is based, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located there, and you consent to their jurisdiction.
